1. About These Terms

These Terms and Conditions govern your engagement with Anjung, a residential advisory practice operating in Kuala Lumpur, Malaysia, with offices at Jalan Ampang Hilir, 55000 Kuala Lumpur.

By contacting us, submitting an enquiry, or entering into a service engagement, you agree to these Terms. Please read them carefully before proceeding.

References to "Anjung", "we", "us", or "our" throughout this document refer to the practice and its appointed advisors. References to "client", "you", or "your" refer to the individual or organisation engaging our services.

2. Nature of Our Services

Anjung provides residential advisory services in Ampang Hilir and the embassy quarter of Kuala Lumpur. Our services include residence search, tenancy coordination, and our Signature Embassy Quarter Programme, as described on our website and in individual service agreements.

We act as advisory consultants, not as licensed real estate agents under the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 (VAEA). Our work involves research, assessment, coordination, and advocacy on your behalf — it does not include brokerage or the formal execution of property transactions in our own name.

We do not hold or manage funds on behalf of clients, other than where written agreement is provided for a defined coordination purpose. All financial arrangements between you and a property owner are made directly between those parties.

3. Engagement and Service Agreement

A formal engagement begins when both parties have signed a written service agreement and the agreed fee or initial retainer has been received. Preliminary consultations and correspondence prior to this point are provided as a courtesy and do not constitute a service engagement.

Each engagement is governed by its service agreement, which specifies the scope of work, fees, timeline, and any conditions specific to the engagement. In the event of any conflict between a service agreement and these Terms, the service agreement shall take precedence for that engagement.

Service agreements are personal to the named client and may not be transferred to a third party without our written consent.

4. Fees and Payment

Our service fees are as published on our website or as specified in your service agreement. Fees are payable in Malaysian Ringgit (MYR) unless otherwise agreed in writing.

Payment terms, including any retainer schedule, milestone payments, or completion fees, are set out in the relevant service agreement. Where a retainer is payable upon engagement, work will not commence until it is received.

Fees are non-refundable once work has commenced on an engagement, except where we are unable to fulfil the agreed scope of service due to circumstances within our control. In such cases, a fair proportion of fees may be refunded at our discretion, reflecting the work completed.

We do not charge referral fees, commissions, or payments from property owners, building managers, or any third party in connection with a client engagement. Our fees are paid solely by the client we represent.

5. Cancellation and Withdrawal

You may withdraw from an engagement by written notice at any time. Where notice is given after work has commenced, fees paid in respect of completed work are not recoverable. Where a defined retainer has been agreed, the retainer is non-refundable following engagement.

We reserve the right to withdraw from an engagement where a client's instructions become materially inconsistent with our ethical standards, where communication has broken down to a degree that prevents effective service delivery, or where circumstances arise that we could not reasonably have anticipated at the time of engagement.

Where we withdraw, we will provide written notice and return any unexpended portion of fees attributable to work not yet commenced.

6. Our Obligations to You

We will perform our services with reasonable skill and care, drawing on our knowledge of the Ampang Hilir residential market and the specific brief you have provided.

We will provide you with honest assessments of properties and situations as we understand them. Where we hold a view that may not align with your initial preference, we will share it clearly and explain our reasoning.

We will keep your instructions and personal information confidential and will not share them with third parties except as necessary to deliver the agreed service or as required by law.

We will respond to your enquiries within one working day during business hours (Monday to Friday, 9 am to 6 pm, Kuala Lumpur time), excluding Malaysian public holidays.

7. Your Obligations to Us

You agree to provide us with accurate and complete information about your requirements, circumstances, and preferences. Where a change in your circumstances materially affects the brief, you agree to inform us promptly.

You agree not to approach directly any property owner, building manager, or other party whom we have identified to you in connection with your engagement, without our prior knowledge. This obligation applies for a period of twelve months from the date of introduction.

You agree to treat our advisors with courtesy and to conduct all engagement-related communication through the channels agreed at the outset of the engagement.

8. Limitation of Liability

Our liability to you in connection with any engagement is limited to the fees paid for that engagement. We are not liable for any consequential, indirect, or special losses arising from our advice or the outcomes of a search or tenancy process, including but not limited to: loss of rental opportunity, costs of additional accommodation, losses arising from a landlord's conduct, or losses arising from market changes.

We provide residential advisory services; we do not provide legal, financial, or investment advice. Where we share general information about lease terms, market conditions, or comparable properties, this is offered for context and should not be relied upon as professional legal or financial guidance. We recommend that clients seek independent legal advice before signing any tenancy agreement.

We do not warrant the accuracy of information provided by third parties (including property owners, building managers, and government agencies) and cannot be held responsible for errors or omissions in such information where we have taken reasonable care in its assessment.

9. Intellectual Property

All materials prepared by us in connection with your engagement — including property dossiers, assessment reports, and written recommendations — are provided for your personal use in the context of that engagement. They may not be reproduced, shared commercially, or used as the basis for representations to third parties without our prior written consent.

The content of our website, including text, design, and photography, is the property of Anjung and may not be reproduced without permission.

10. Privacy

The collection and use of your personal information is governed by our Privacy Policy, which forms part of our engagement with you. By engaging our services, you acknowledge that you have read and understood our Privacy Policy.

11. Governing Law and Disputes

These Terms, and any engagement governed by them, are subject to the laws of Malaysia. The courts of Malaysia have jurisdiction over any dispute arising in connection with our services.

Where a dispute arises, we invite you to contact us directly in the first instance to seek a resolution. We are committed to addressing concerns promptly and in good faith. If a resolution cannot be reached through direct discussion, either party may refer the matter to a mutually agreed mediator before commencing formal proceedings.

12. Amendments to These Terms

We may update these Terms from time to time to reflect changes in our practice or in applicable law. The current version will always be available on our website. Changes to these Terms do not affect engagements already underway, which continue to be governed by the Terms in force at the time of the service agreement.
